Welcome to Truckerly. These Terms of Service and End User License Agreement (“Terms”) govern your access to and use of the Truckerly mobile application, website, and related services (collectively, the “Service”) operated by Truckerly (“Truckerly,” “we,” “us,” or “our”).
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.
You may not use the Service if:
- your use would violate any applicable law or regulation;
- you have previously been suspended or removed from the Service; or
- you are prohibited from using the Service under applicable law.
2. Description of the Service
Truckerly is a trip, mileage, expense, and receipt organization platform designed primarily for trucking professionals and businesses.
Features may include:
- trip tracking;
- expense tracking;
- receipt image uploads;
- PDF summary reports;
- mileage calculations based on user-entered data;
- subscription-based premium features.
The Service is intended solely as an organizational and recordkeeping tool.
Truckerly does not provide:
- accounting services;
- tax advice;
- legal advice;
- payroll services;
- financial advisory services;
- audit preparation services; or
- regulatory or DOT compliance services.
Reports, summaries, exports, and calculations generated by the Service are informational only and should be independently reviewed before use for taxes, reimbursements, audits, legal filings, or regulatory purposes.
3. Accounts and Authentication
Certain features require an account.
You may create an account using:
- email and password;
- Sign in with Google; or
- Sign in with Apple.
You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activities occurring under your account; and
- promptly notifying us of unauthorized account access.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions and Billing
The Service may offer free and paid subscription tiers.
Subscriptions may be billed:
- monthly; or
- annually.
Payments may be processed through:
- Apple App Store;
- Google Play Store; or
- Stripe.
App Store Purchases
If you purchase a subscription through Apple or Google:
- billing and refunds are governed by the applicable app store’s terms and policies;
- Apple and Google are solely responsible for payment processing related to in-app purchases made through their platforms.
Automatic Renewal
Subscriptions automatically renew unless canceled before the renewal date through the applicable platform or payment provider.
Feature Restrictions After Expiration
If a paid subscription expires:
- you may continue accessing existing data;
- certain premium features may become unavailable, including adding new records or generating reports.
5. User Data and Content
You retain ownership of the information, receipts, images, and content you upload to the Service (“User Content”).
By uploading User Content, you grant Truckerly a limited license to host, store, process, transmit, and display such content solely for purposes of operating and improving the Service.
You agree not to upload:
- unlawful content;
- infringing materials;
- malicious software;
- fraudulent records; or
- content that violates the rights of others.
6. Data Storage, Retention, and Deletion
Data may be temporarily stored locally on your device prior to upload and synchronization.
Truckerly uses third-party cloud infrastructure providers, including Firebase, to store and process Service data.
Backups
While limited backups may be maintained, Truckerly does not guarantee permanent storage, preservation, or recovery of any data.
Users are solely responsible for maintaining independent backup copies of important records and receipts.
Inactive Accounts
Accounts inactive for two (2) years may be permanently deleted, along with associated data.
Account Deletion Requests
You may request deletion of your account and associated cloud-stored data by contacting:
Deletion requests may require verification of account ownership.
7. Accuracy of Information
You are solely responsible for:
- the accuracy of trip records;
- mileage entries;
- expense information;
- receipt uploads;
- tax classifications; and
- generated reports.
Mileage calculations and summaries are based entirely on user-provided information.
Truckerly does not guarantee:
- accuracy;
- completeness;
- tax eligibility;
- deduction qualification;
- reimbursement approval;
- audit outcomes; or
- compliance with laws or regulations.
8. Future Automated or AI Features
Certain future features may utilize automated systems, machine learning, artificial intelligence, or third-party AI services.
Any automated outputs may contain inaccuracies, omissions, or errors and should be independently reviewed before reliance.
9. Acceptable Use
You agree not to:
- use the Service unlawfully;
- interfere with Service operations;
- attempt unauthorized access;
- reverse engineer the Service;
- distribute malware or harmful code;
- scrape or copy Service content;
- use the Service to violate laws or regulations.
We may suspend or terminate accounts violating these Terms.
10. Intellectual Property
The Service, including software, branding, logos, graphics, interfaces, and content provided by Truckerly, is owned by Truckerly, LLC and protected by intellectual property laws.
Subject to these Terms, Truckerly grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes.
You may not:
- reproduce;
- resell;
- distribute;
- modify; or
- commercially exploit the Service without written permission.
11. Third-Party Services
The Service may integrate with or rely upon third-party services including:
- Firebase;
- Stripe;
- Apple;
- Google; and
- other providers.
Truckerly is not responsible for third-party services, systems, outages, policies, or actions.
Use of third-party services may also be governed by their own terms and privacy policies.
12. App Store Terms
Apple App Store
If you downloaded the app from Apple:
- Apple is not responsible for the Service or its content;
- Apple has no obligation to provide maintenance or support;
- Apple is not responsible for addressing claims related to the app.
You acknowledge Apple and its subsidiaries are third-party beneficiaries of these Terms.
Google Play
If downloaded from Google Play, your use of the app must comply with Google Play terms and policies.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUCKERLY, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- NON-INFRINGEMENT;
- DATA ACCURACY; AND
- UNINTERRUPTED AVAILABILITY.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE ERROR-FREE;
- DATA WILL NEVER BE LOST;
- REPORTS WILL BE ACCURATE;
- THE SERVICE WILL MEET ALL USER NEEDS; OR
- THE SERVICE WILL ALWAYS BE AVAILABLE OR SECURE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUCKERLY, LLC AND ITS OWNERS, MEMBERS, AFFILIATES, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR:
- INDIRECT DAMAGES;
- INCIDENTAL DAMAGES;
- SPECIAL DAMAGES;
- CONSEQUENTIAL DAMAGES;
- LOST PROFITS;
- LOST DATA;
- TAX PENALTIES;
- AUDIT OUTCOMES;
- BUSINESS INTERRUPTION; OR
- FINANCIAL LOSSES.
IN NO EVENT SHALL TOTAL LIABILITY EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID TO TRUCKERLY DURING THE PREVIOUS TWELVE (12) MONTHS; OR
- $100 USD.
Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless Truckerly, LLC and its affiliates from claims, damages, liabilities, and expenses arising from:
- your use of the Service;
- your User Content;
- your violation of these Terms; or
- your violation of any law or third-party rights.
16. Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY.
You and Truckerly agree that disputes arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”).
Arbitration shall take place in Oklahoma under AAA Consumer Arbitration Rules.
You waive the right to:
- participate in class actions;
- participate in class arbitrations; and
- have disputes decided by a jury trial.
This arbitration agreement survives termination of these Terms.
You may opt out of arbitration within thirty (30) days of first accepting these Terms by sending written notice to:

17. Class Action Waiver
To the fullest extent permitted by law, all disputes must be brought solely in an individual capacity and not as part of any class, collective, consolidated, or representative proceeding.
18. Termination
We may suspend or terminate access to the Service at any time for:
- violations of these Terms;
- unlawful conduct;
- abuse of the Service; or
- operational or security reasons.
You may stop using the Service at any time.
Sections intended to survive termination will remain enforceable.
19. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles.
20. Changes to These Terms
We may update these Terms periodically.
Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
